Welcome to Terra Madre.

These Terms of Service ("Terms") apply to your use of the Terra Madre website, online store and related services (collectively, the "Services"). The terms "Terra Madre", "we", "us" and "our" refer to Terra Madre, and "you" and "your" refer to the person using or purchasing from our Services.

Terra Madre operates its online store using Shopify, which provides the technology that enables us to offer our Services.

Please read these Terms carefully before using our website or placing an order. By accessing or using our Services, you agree to these Terms, together with our Privacy Policy, Shipping Policy and Return & Refund Policy.

If you do not agree with these Terms, please do not use our website or Services.

Nothing in these Terms is intended to limit or exclude any rights you may have under applicable South African law.


SECTION 1 – ACCESS AND USE OF OUR WEBSITE

You may use our website for lawful purposes and in accordance with these Terms.

You must provide accurate and complete information when placing an order or creating an account with us. This includes your name, contact details, billing information and delivery address.

You are responsible for ensuring that the information you provide remains accurate and up to date.

If you create an account on our website, you are responsible for keeping your login information confidential and for all activity carried out through your account.

Our Services are intended for persons who are legally capable of entering into binding agreements under applicable South African law.


SECTION 2 – OUR PRODUCTS

We make every reasonable effort to ensure that product descriptions, photographs, prices and other information displayed on our website are accurate and up to date.

Product photographs are provided for illustrative purposes. Colours and the appearance of products may vary slightly depending on your screen, device and settings.

Natural products may also vary slightly in colour, appearance, texture or flavour from one batch to another. Such variations do not necessarily indicate a defect.

Product information, descriptions, availability and packaging may change from time to time.

We reserve the right to discontinue products, limit quantities or restrict the sale of particular products to certain locations where reasonably necessary, including where delivery conditions do not allow us to safely deliver a product.

Where a product has specific storage, refrigeration, use-by or other handling requirements, these will be communicated on the product packaging or relevant product page.


SECTION 3 – ORDERS

When you place an order through our website, you are requesting to purchase the products selected by you.

Your order is subject to acceptance and product availability.

Once your order has been successfully submitted and payment has been authorised or received, we will provide confirmation of the order using the contact details you provided.

We may contact you if there is a problem with your order, including where:

  • a product is unavailable;

  • there is an error in the product description or price;

  • the delivery address is outside the applicable delivery area;

  • we are unable to fulfil the order; or

  • additional information is reasonably required to process the order.

If we are unable to fulfil an order that has already been paid for, we will notify you and arrange an appropriate refund where applicable.

You should review your order carefully before completing your purchase.

Orders and returns are subject to our Return & Refund Policy, which forms part of these Terms.

Nothing in this section limits any cancellation, return or other rights available to consumers under applicable South African law.


SECTION 4 – PRICES AND PAYMENT

All prices displayed on our website are in South African Rand (ZAR), unless otherwise stated.

Prices, promotions and discounts may change from time to time. The price applicable to your purchase will be the price displayed at the time you place your order, subject to correction of genuine pricing or display errors.

Applicable delivery charges will be displayed or communicated before your order is completed.

You agree to provide accurate and complete payment and billing information.

Payments are processed through the payment methods made available through our website. Terra Madre does not knowingly retain full payment card details where these are processed through third-party payment providers.

If a payment is declined, reversed or otherwise cannot be successfully processed, we may be unable to fulfil the relevant order until payment has been successfully received.

Promotional offers may be subject to additional terms. Where specific promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.


SECTION 5 – SHIPPING AND DELIVERY

Our Shipping Policy forms part of these Terms.

Non-perishable Terra Madre products may be delivered throughout South Africa, subject to courier availability and the applicable delivery area.

Cold-pressed juices are available only for delivery to selected areas of the Western Cape because of their refrigerated and perishable nature.

Delivery times provided by Terra Madre or our courier partners are estimates. While we will make reasonable efforts to have orders delivered within the stated timeframe, delays may occur due to courier operations, weather, public holidays, unforeseen events or circumstances outside our reasonable control.

You are responsible for providing an accurate delivery address and contact information and for making reasonable arrangements to receive your order.

Where a delivery cannot be completed because incorrect delivery information was provided or no reasonable arrangements were made to receive the order, additional delivery charges may apply where applicable.

Nothing in this section limits Terra Madre's obligations or your rights under applicable consumer law where goods are defective, damaged or otherwise fail to meet the required standards.


SECTION 6 – RETURNS, REFUNDS AND DEFECTIVE PRODUCTS

Our Return & Refund Policy forms part of these Terms.

Due to the nature of food products, Terra Madre does not generally accept returns simply because a customer has changed their mind or no longer wants a product.

This does not affect any statutory rights available to consumers.

Under the Consumer Protection Act 68 of 2008, consumers have rights relating to the quality, safety and suitability of goods. Where goods fail to meet the applicable requirements, the remedies available under the Act may include repair, replacement or refund, depending on the circumstances.

Where a product arrives damaged, leaking, spoiled, defective or incorrect, please contact us as soon as reasonably possible after delivery so that we can investigate and assist.

For perishable products such as cold-pressed juices, customers should contact us as soon as possible after delivery if the product arrives in an unsuitable condition.

Nothing in our Return & Refund Policy or these Terms is intended to waive, restrict or exclude any consumer rights that cannot lawfully be excluded.


SECTION 7 – INTELLECTUAL PROPERTY

All content appearing on the Terra Madre website, including but not limited to our name, logo, branding, photographs, product images, graphics, text, recipes, illustrations, designs and other materials, belongs to Terra Madre or is used by Terra Madre with permission.

This content is protected by applicable intellectual property laws.

You may view and use the website for your personal, non-commercial purposes.

You may not reproduce, copy, modify, distribute, republish, sell or commercially exploit Terra Madre's website content, branding, photographs or other intellectual property without our prior written permission.

Terra Madre's name, logo, product names, designs and other brand elements may not be used without our prior written permission.

All third-party trademarks and intellectual property appearing on our website remain the property of their respective owners.

SECTION 9 – SHOPIFY

Terra Madre is powered by Shopify, which provides the technology used to operate our online store and Services.

Any purchase you make through our online store is a transaction between you and Terra Madre.

Shopify is not responsible for the products sold by Terra Madre, the fulfilment of your order, or any dispute between you and Terra Madre relating to a purchase.

Shopify's role is limited to providing the technology and services that enable Terra Madre to operate its online store.


SECTION 10 – PRIVACY AND PERSONAL INFORMATION

Personal information collected through our website is handled in accordance with our Privacy Policy.

When you place an order, we may collect information such as your name, contact details, billing information, delivery address and payment-related information in order to process and fulfil your order.

Because our online store is powered by Shopify, certain information may also be processed by Shopify and other service providers involved in operating our website, processing payments, delivering orders or providing related services.

Personal information may be processed or stored outside South Africa where necessary for the provision of these services, subject to applicable data protection requirements.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot lawfully be excluded under the Consumer Protection Act or other applicable South African legislation.

Nothing in these Terms limits a consumer's statutory rights or remedies in relation to defective, unsafe or unsuitable goods.

Where liability may lawfully be limited, Terra Madre's liability will be limited to the extent permitted by applicable law and the circumstances of the particular claim.


SECTION 18 – INDEMNIFICATION

You agree to use our website lawfully and responsibly.

To the extent permitted by applicable law, you may be responsible for losses or claims suffered by Terra Madre as a direct result of your unlawful use of the website, fraud, deliberate misuse of the Services or infringement of another person's rights.
